By using this website (located at jervisbaydistilling.com.au), any related websites or URLs, social media platforms owned or operated by us (Sites) and our services, including making a purchase through the Sites, purchasing a Subscription Service from us and use of our contact form (collectively, the Services), you agree to be legally bound by these Terms and Conditions (Terms).

1.2. By agreeing to these Terms, you are entering into an agreement with Jervis Bay Distilling Co Pty Ltd (ABN 59 633 664 294) trading as Jervis Bay Distilling Co, including its successors, assignees and related bodies corporate (as defined in the Corporations Act 2001 (Cth)).

1.3. By accessing or using our Services, you warrant and represent that:

(a) you have read, understood and agree to be bound by these Terms;

(b) you are over 18 years of age and are not purchasing alcohol on behalf of a person under
18; and

(c) you have the legal capacity and authority to enter into this agreement.

1.4. Our linked policies, including our Privacy Policy, Shipping Policy and Returns Policy,
form part of these Terms.

2.1. You are responsible for ensuring your use of our Services complies with all applicable laws in your jurisdiction.

2.2. You must not use our Services for unlawful, discriminatory or harmful activity, or in a way that infringes the rights of others.

2.3. By providing your details, you confirm they are accurate and that you consent to being contacted regarding your orders and, where you have opted in, for marketing purposes.

2.4. We only send marketing communications in accordance with the Spam Act 2003 (Cth). All marketing emails and SMS clearly identify us as the sender and include an easy, no-cost
unsubscribe option.

3.1. Orders are accepted once you have submitted payment in full (including delivery charges and taxes) and received an order confirmation from us.

3.2. By placing an order, you make an offer to purchase the selected goods for the displayed price (inclusive of GST and exclusive of delivery fees unless stated otherwise).

3.3. We reserve the right to:

(a) accept or reject any order (in whole or part);

(b) request photo ID or other verification before processing;

(c) cancel or vary an order where products are unavailable, pricing errors occur, or fraud is
suspected; and

(d) limit quantities to reasonable household amounts.

3.4. If we cancel an order for any reason other than your breach, you will receive a full refund of amounts paid.

4.1. Orders cannot be amended or cancelled once placed, except as required under the Australian Consumer Law (ACL).

4.2. Where a lawful cancellation applies, you agree to be liable for any direct losses incurred as a result of the cancellation, except where prohibited by law.

8.1. We deliver alcohol only within Australia and only as next-day or later delivery. We do not offer same-day or express alcohol delivery.

8.2. All deliveries comply with relevant state and territory liquor laws.

8.3. Alcohol deliveries must be accepted by a person aged 18 years or over. Acceptable proof of age may be requested upon delivery.

8.4. If you provide an authority to leave at checkout, we may leave your order unattended at the delivery address if we deem it safe and compliant with local laws. If no authority to leave is given and no eligible recipient is present, redelivery fees may apply.

8.5. Risk in the goods passes to you upon delivery to an 18+ recipient or, where authority to leave has been given, when the goods are left at the nominated address.

8.6. Estimated delivery dates are provided for guidance only. Delays may occur due to shipping, weather or stock conditions, but you remain entitled to your ACL remedies if goods are not delivered within a reasonable time.

12.1. Jervis Bay Distilling Co supports the Responsible Service of Alcohol (RSA) and complies with all relevant state and territory liquor laws.

12.2. We do not sell or supply alcohol to persons under 18 years of age. By purchasing, you warrant you are over 18 and not buying alcohol on behalf of a minor.

12.3. We may verify your age at checkout and on delivery and refuse or cancel any order if we cannot confirm eligibility.

(a) replacement or resupply of goods;

(b) repair of goods; or

(c) refund of the purchase price paid.

13.3. Nothing in these Terms excludes or limits your statutory rights under the ACL.

• Waiver: Failure to enforce any term does not constitute a waiver.
• Severability: If any provision is invalid, the remaining provisions remain in effect.
• Force Majeure: We are not liable for delays caused by events beyond our control.
• Entire Agreement: These Terms and linked policies constitute the entire agreement between you and us.
• Jurisdiction: These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of its courts.
